Terms of Service

PhotoshootMaker is a product of Cloud Dream, LLC. These terms are an agreement between you and Cloud Dream, LLC ("we") for the use of PhotoshootMaker at photoshootmaker.com (the "Service"). By creating an account or using the Service you accept them. If you use the Service on behalf of an organisation, you confirm you are allowed to bind it.

PhotoshootMaker is a web service that helps you upload a few photos and get a complete themed photoshoot, ready to download. You submit a task from your studio, it runs in the background and the result is saved to your account for download.

The Service is offered as described on the site. We may improve, change or retire features over time; we will give reasonable notice before removing something you rely on.

• You must be at least 18 years old and provide accurate information.
• Keep your sign-in details confidential. You are responsible for activity under your account and must tell us about any unauthorised use.
• One person per account. Do not share, sell or transfer an account.

• There are no free credits: every photoshoot is paid for with credits you buy.
• Every photo costs 2 credits, so a photoshoot of 10 photos uses 20 credits. The price is shown before you generate. Credits are deducted when a photoshoot is accepted and your balance can never go below zero.
• If a photo fails, its credits are returned to your account automatically and both the charge and the refund appear in your transaction history.
• Credit packs are one-time purchases. Purchased credits do not expire while your account exists.
• Prices are shown on the pricing page and may change. A change applies to future purchases only.

Payments are processed by Stripe. Prices are shown in the currency on the pricing page and may be subject to taxes that Stripe calculates at checkout.

Because credits are delivered to your account immediately, purchases are not refundable once credits have been added, except where consumer law gives you a right that cannot be waived. Credits returned for failed tasks are always returned as credits, not as money.

If something went wrong with a purchase, contact us and we will look into it.

You keep all rights to the photos you upload and to the photoshoots the Service produces for you. You grant us only the permission needed to store, process and deliver them back to you.

You are responsible for your content. Do not submit anything unlawful, anything that infringes the rights of others, or personal data about other people that you have no right to use.

You agree not to:

• interfere with the Service, probe it for vulnerabilities or place unreasonable load on it;
• circumvent billing, credit limits or access controls;
• access another person’s account or data;
• scrape, resell or sublicense the Service without our written permission;
• use the Service to send spam or to break the law.

We work to keep the Service available and your data safe, but we do not promise uninterrupted operation. Maintenance, provider outages and events outside our control can cause downtime. Where a task is lost because of an outage, its credits are refunded.

You can stop using the Service at any time and delete your account under Settings in the studio. Download anything you want to keep first; remaining credits end with the account.

We may suspend or close an account that breaks these terms, after warning you where that is reasonable. Credits on an account closed for abuse are forfeited. If we discontinue the Service, we will give you reasonable notice so you can download your work.

The Service is provided "as is". To the extent permitted by law we exclude all warranties, and our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect losses such as lost profits or lost data. Nothing in these terms limits liability that cannot be limited by law, including for fraud, death or personal injury.

These terms are governed by the laws of the country in which Cloud Dream, LLC is established, and disputes are handled by the courts there, without prejudice to any mandatory consumer protection you enjoy where you live.

We may update these terms. The date at the top shows the current version. For material changes we will give notice on the site or by email before they take effect, and continued use after that date means you accept the new terms.
